A case of intercompany conflict was observed between Apple and Samsung when Apple filed a case against Samsung in 2011 in California, UK, Japan and Germany. Apple claimed that it was the first company to introduce Multi-Touch(R) interface in a cell phone. Its distinctive user interface, icons, and displays along with glass and stainless-steel case were infringed by Samsung. Apple accused Samsung of breaching 8 utility patents, 6 trade dress rights and 7 design patents. As a counter-claim Samsung lodged a case against Apple stating that Apple breached 5 utility patents of Samsung. These claims and counter-claims continued for nearly four years before the American jury could come to a decision. In 2014 it was ruled that Samsung violated two Apple designs and was ordered to pay Apple USD 119,625,000 and Apple violated one patent of Samsung and was ordered to pay USD 158,400 (Saardchom, 2014). This conflict provided valuable insight to the issues and risks faced by the smartphone industry in terms of design patents.
