Summarize the importance of the Fourth Amendment in the USA, specifically as it applies to forensic investigations.
Provide your opinion on the Fourth Amendment's relevance to forensic investigations.
The fourth amendment was created by the founding fathers to limit the power of government into searching private homes for evidence relating any crimes (Renan, 2016). The founding father banned general warrants for ensuring that all seizures and searches were reasonable and that a warrant could particularly define what all areas could be investigated and which items or individual could be seized (Garrett & Stoughton, 2017). When an investigator with a warrant enters into a home he or she enables the search from the Fourth amendment, because of the invasion of the predetermined privacy of the person. The search can be as particular as the warrant states of as general. When an investigator is at an individual's house, he is in an open area for looking around as well as for opening any kinds of cabinets or doors it requires to be particular in the warrant. The major problem that arises with the fourth amendment is the utilisation of the amendment with the digital crimes taking place at present. For understanding the relationship, firstly computer was taken by comparing computer as a home or any other sealed container. A computer incorporates a hard drive, which has the contents of an individual's History, pictures, documents etc (Donohue, 2016). Just as person often has a reasonable expectation of privacy in his packages and his home, so the hard drives on an individual's computer is his private or personal property, and the fourth amendment applies upom computer storage devices similar to any other private property.
