Ethical Standards
Question :
How are APA Ethical Standards 2.0f, 3.06, 4.04, 4.05, 5.01, 9.01a and 9.06 relevant to this case? Which other standards might apply?
Answer :
He is not involved in the case to determine the punishment or to decide the crime of John, however, John has made a confession regarding the murder to the guard as well as the boy waiting for the bus. Here, 2.0f could be applied in the case. Ethical standard 3.06 could be applied if the psychologist may not take the case because of the fact that his feeling may affect his decision (Rainer et al., 2018). Dr. Romaro has mixed feeling about the death penalty and if his decision is being affected by his feeling of the death penalty that may lead to giving a biased opinion on the mental ability of John and he is refusing to be further engaged in the case, 3.06 could be applied. Ethical standard 4.04 is also relevant to the case because John has made a confession in which he accepted that he has murdered the guard while robbery in the bank. Apart from this, he also accepted the murder of the boy who was waiting for the bus. It is the responsibility of the doctor to report the confession made by John even if it seemed to be an anxiety attack. Ethical standard 4.05 is also relevant to this case because now it is the responsibility of the doctor to communicate what has been said by John during the test in order to stop others from possibly getting hurt. Ethical standard 9.01 deals with the fact that the doctor did not receive a prior report about the mental ability of John and hence he has to base his decision on what he found during the test (de Barros Souza et al., 2017). 9.06 provides a right to the patient to appeal to go through his background before determining anything in order to ensure justice.
Dr. Romaro is needed to take everything into consideration that has been collected during the test in order to ethically implement the decision and monitor the effect of the decision including the confession made by John. He needs to ensure that his feeling about a particular thing does not affect his decision because if the decision of the doctor is being affected by the feelings of the doctor, he may produce a biased report favoring either John or the decision of the court. Thus, the doctor should really ensure that his personal feeling is not affecting his decision. The only thing that should be followed by the doctor is the finding of the test. The decision of the doctor should be completely based on what he found in the test (Noothigattu et al., 2018). The doctor should also not come with the conclusion that John has committed the crime and hence he should be given the death penalty or he has not done the crime or his mental ability is not good and hence his death penalty should be eliminated. The doctor should prepare the report based on what he found during the test and the rest should be left for the court to decide.
